About these terms
This website is operated by The Diving Centre Ltd, a company based at Cleadon Lane Industrial Estate, East Boldon, South Tyneside, NE36 0AH, VAT registration number 886672169. By using the site, placing an order, or booking a course or trip, you agree to these terms. If you do not agree with them, please do not use the site or buy from us.
We may update these terms from time to time. The version that applies is the one published on the site when you place your order or booking.
Using our website
You may use the site for lawful purposes only. You agree not to misuse it, attempt to gain unauthorised access, introduce harmful code, or use it in any way that could damage the site or affect other users. We may suspend or withdraw access to the site at any time without notice if needed.
We try to keep the site available and accurate, but we cannot guarantee it will always be uninterrupted or free of errors.
Intellectual property
All content on this site, including text, images, logos, graphics and design, belongs to The Diving Centre Ltd or its licensors and is protected by copyright and other rights. You may view and print content for your own personal use, but you may not copy, reproduce or use it commercially without our written permission.
Products and pricing
We take care to describe and price our products accurately, but errors can occur. Colours and images may vary slightly from the actual item. All prices are shown in pounds sterling and include VAT where applicable. If we find a pricing or description error after you order, we will contact you to confirm whether you wish to continue at the correct price or cancel.
Products are subject to availability. We may change prices or withdraw products at any time, but changes will not affect orders we have already accepted.
Orders and payment
When you place an order, you are making an offer to buy. We accept your order when we send confirmation or dispatch the goods, at which point a contract is formed. We may decline an order, for example if an item is out of stock or we cannot take payment.
Payments are processed securely by Stripe. We do not store your full card details. Your statutory rights as a consumer are not affected by these terms.
Delivery
We will let you know the delivery options and estimated timescales at checkout. Delivery times are estimates and not guaranteed. Risk in the goods passes to you on delivery. If an item is lost or damaged in transit, please contact us so we can put it right.
Returns and refunds
If you are a consumer buying online, you generally have the right to cancel within 14 days of receiving your order and return it for a refund under the Consumer Contracts Regulations. Some items are excluded, such as goods that have been used, made to order, or unsealed where this affects hygiene or safety.
Returned items should be in their original condition. If goods are faulty or not as described, you have additional rights under the Consumer Rights Act 2015. To start a return, please contact us first and we will guide you through it.
Courses, trips and bookings
Some courses and trips require a deposit when you book, with the balance due before the start date. The exact deposit, payment and cancellation terms will be confirmed at the time of booking, so please check them before you pay.
- If you need to cancel or rearrange, contact us as soon as possible. Deposits may be non-refundable, and cancellation charges may apply closer to the date.
- Some trips and courses depend on minimum numbers, suitable conditions and availability. If we have to cancel or reschedule, we will offer you an alternative date or a refund of amounts paid for that booking.
- Course materials, certification fees and equipment hire may be charged separately and will be made clear when you book.
Fitness to dive and safety
Diving, training and related activities carry inherent risks. To take part you must complete any medical declaration honestly, meet the entry requirements for the activity, and follow the safety instructions given by our staff and instructors at all times.
We may refuse or stop your participation if we reasonably believe it is unsafe, for example based on your medical information, conduct, or conditions on the day. Where we do this on safety grounds, it does not entitle you to a refund beyond any amount we choose to offer. Certain courses require you to hold a relevant prior qualification, which we may ask you to evidence.
Our liability
We will carry out our services with reasonable care and skill. We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care, but we are not responsible for loss that is not foreseeable, or for losses connected with your business.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under the law. You take part in diving activities on the understanding that you have given accurate information and will follow the safety guidance provided.
Events outside our control
We are not liable for failure or delay in meeting our obligations where this is caused by events beyond our reasonable control, such as severe weather, unsafe water conditions, supplier failures or other circumstances we could not reasonably have foreseen. Where this affects a booking, we will contact you to arrange an alternative or a refund of amounts paid for the affected booking.
Governing law
These terms are governed by the law of England and Wales, and any disputes will be subject to the courts of England and Wales. This does not affect your statutory rights as a consumer.
